About these terms

Computer Buddy (“Buddy”) is a product of Nemeda Iparralde SL, Lamisingo Iturria 1, Edificio Arretxe-Ugalde, Oficina 109-A, 20305 Irún (Gipuzkoa), Spain (“Nemeda”, “we”). These terms apply to the Buddy apps for Mac, Windows and iPhone, to the managed service at computerbuddy.app and to this website.

By using Buddy you accept these terms. If you use Buddy through your organisation, your organisation’s agreement with Nemeda prevails over these terms where they differ.

Accounts and access

Your organisation’s administrators decide who can use Buddy, with which models, policies and limits. Keep your sign-in methods secure and tell us or your administrator about any unauthorised use. You are responsible for what is done with your account.

Using Buddy

Buddy is an AI agent that works on your computer, with your files, your browser and the services you connect, following your instructions. AI output can be inaccurate or incomplete: review Buddy’s work before relying on it, and confirm actions with consequences, such as sending messages, deleting files or making changes in other services. You are responsible for the actions you ask for or approve.

Acceptable use

You must not use Buddy to:

  • break the law or infringe the rights of others, including intellectual property and privacy;
  • create or spread malware, spam or deceptive content;
  • access systems, accounts or data you are not authorised to use;
  • get around Buddy’s security, limits or policies, or disrupt the service;
  • breach the terms of the AI models or connected services you use through Buddy.

Your content

Your files, instructions and the results Buddy produces for you remain yours. You give Nemeda only the rights needed to provide the service to you. We do not use your content to train AI models.

AI models and other services

Buddy uses AI models from third-party providers, either through Buddy’s managed service or through your own API account. Connectors, plugins and skills give Buddy access to services from other companies, under those companies’ own terms and privacy policies. Nemeda is not responsible for third-party services or for content they provide.

Fees

Fees for the managed service are those agreed with your organisation. When you use your own API account, your provider bills that usage directly.

Our software and brand

Buddy, its software and its brand belong to Nemeda. We give you a limited, non-exclusive, non-transferable licence to use the apps while you have access to Buddy. Do not copy, resell or reverse-engineer them, except where the law expressly allows it.

Changes and availability

We improve Buddy continuously and may change or remove features. Features marked as beta or preview may change more often. We work to keep the service available, but cannot guarantee it will be uninterrupted or error-free.

Suspension and termination

You can stop using Buddy at any time. We may suspend or end access that breaks these terms or puts the service, other users or third parties at risk, telling you or your organisation where reasonable.

Liability

To the extent permitted by law, Buddy is provided “as is”, and Nemeda is not liable for indirect or consequential losses, or for loss of data, profit or business. Nothing in these terms limits liability for fraud, wilful misconduct or gross negligence, or anything else the law does not allow to be limited, nor the statutory rights of consumers.

Privacy

How we handle personal data, including data from the services you connect, is described in the privacy policy at computerbuddy.ai/privacy.

Changes to these terms

We may update these terms. We will publish the new version on this page with its date and, for significant changes, tell you or your organisation in advance.

Governing law

These terms are governed by Spanish law. The courts of Donostia-San Sebastián have jurisdiction, without prejudice to any mandatory rights consumers have to go to the courts where they live.
